OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING.

1. HOW TO ENTER

a. These rules govern the KRTH Yellow Pages- Michael Jackson Immortal Show promotion (the “Promotion”) being conducted by KRTH (FM) (the “Station”) beginning on Thursday May 31, 2012 at 12:00am Pacific Time (“PT”) and ending on Sunday, June 24, 2012 at 11:59pm PT (the “Promotion Period”).

b. To participate in the Promotion, you must log onto Kearth101.com during the Promotion Period and follow the links and instructions to enter the Promotion and submit the requested information in the online entry form and upload a screen shot of their phone with the Yellow Pages App installed on it (Yellow Pages App is free to upload) in the form of a JPEG no larger than 25mg (“Photo Submission”). Only one (1) entry per person is permitted, and only one (1) entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. Entries submitted will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. Station’s computer is the official time keeping device for the Promotion. The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems.

c. Photo Submissions must be the entrants’ original, creative work, and must not be protected by copyright; each entrant must have the right to submit it. The Photo Submissions may not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights including but not limited to copyrights or trademarks. Each Photo Submission must only be of the entrant and photos with other people in addition to the entrant are not eligible. The Photo Submissions must not contain copyrighted materials or any other materials that may be restricted, prohibited or outlawed by federal, state or local laws. KRTH-FM in its sole discretion, reserves the right to disqualify any entry if such entry’s associated Photo Submission or other content contains illegal, indecent, pornographic, sexually explicit content or otherwise offensive material such as aberrational behavior, graphic violence or drug abuse, or if such Photo Submission or other content contains any nudity, material whose content is deemed at the sole discretion of KRTH -FM to be unsuitable for public display, broadcast, or posting on the Stations’ website(s) (i.e., entries must be radio clean). Entries that do not comply with these rules will not be eligible for the competition.

d. IMPORTANT NOTE: Any entrant who incorporates any intellectual property or material owned by a third party into his or her Screen Shot does so at his or her own risk. Without in any way limiting, expanding or amending the Terms of Use policy residing on http://www.kearth101.com which Terms of Use policy shall remain in full force and effect, if the Station is duly notified that any element of an entrant’s Screen Shot infringes upon the rights of another person and/or receives a legally valid request to remove the affected content from the Website because of such infringement, such content may be removed from the Website and/or disqualified from the Promotion, as the Station may determine in its sole discretion. Further, no entrant will be eligible to receive a prize unless the Station determines, in its sole and absolute discretion that such entrant’s Screen Shot has been or can be sufficiently cleared for legal purposes.

e. Each person who enters this Promotion represents and warrants as follows: (i) the content he/she is submitting does not contain any computer virus (as applicable), is otherwise uncorrupted, is wholly original with entrant, and as of the date of submission, is not the subject of any actual or threatened litigation or claim; (ii) the content does not and will not violate or infringe upon the intellectual property rights or other rights of any other person or entity; and (iii) the Screen Shot does not and will not violate any applicable laws, and is not and will not be defamatory or libelous. Each entrant hereby agrees to indemnify and hold the Station harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of entrant hereunder.

f. All entries must be received by 11:59pm PT on Sunday, June 24, 2012.

2. ELIGIBILITY RESTRICTIONS

a. The Promotion is open to all persons who are 18 years of age or older and who reside in one (1) of the following Southern California Counties: Los Angeles, Orange, Riverside, San Bernardino, San Diego and/or Ventura. Employees of the Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, Station’s advertising and promotional agencies, its participating sponsors, other radio stations in the Los Angeles metropolitan area, the members of their immediate families (spouse, parent, sibling or child) and those living in the same household of each (whether related or not), are ineligible to enter or win. This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited.

b. Persons are eligible to win a prize valued at $50 or more or event tickets valued at $100 or more from the Station only once every thirty (30) days, and listeners are eligible to win a prize in a Promotion conducted by the Station only once every sixty (60) days if the prize is valued over $600 and only once per year if prize is valued over $1,000. Only one (1) winner per household is permitted in any Station promotion.

c. Each winner must provide valid government-issued photo identification and provide their complete address, date of birth and phone number to claim a prize.

d. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements. The Station will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

3. PRIZES

a. One (1) prize will be awarded in this Promotion. Each prize includes the following: two (2) tickets to see Michael Jackson Immortal Show from the CBS Radio Suite on August 14, 2012 at the Staples Center located at 1111 South Figueroa Street Los Angeles, California 90015. The Approximate Retail Value (“ARV”) of the prize is $175.00.

b. All other costs not specifically stated herein, including but not limited to those of, taxes and ground transportation to/from the Staples Center, are the responsibility of the prize winner. The prize winner and companion(s) may be required to sign a Publicity and Liability Waiver form prior to claiming the prize. If a selected event is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, or for any reason beyond the control of the Station, the Station’s sole responsibility to the winner will be to award the remaining available portion of the prize and no substitution or compensation will be provided for the unawarded portion of the prize. The Station reserves the right to remove or to deny entry to the winner and/or companion(s) if either engages in a disruptive manner or with intent to annoy, abuse, threaten or harass any other person at any qualifying prize and/or grand prize-related event. If the guest is under 18 years of age, the winner must be the guest’s parent and/or legal guardian.

c. All prizes or prize certificates may be picked up during regular business hours at the Station office at the address below. The winners will forfeit any prize or prize certificate not claimed within thirty (30) days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.

d. There is no substitution, transfer or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes or cash of comparable value. The prizes are expressly limited to the item(s) listed above and unless otherwise expressly specified, do not include taxes, parking, gratuities or any other expenses. Other restrictions may apply.

4. WINNER SELECTION AND NOTIFICATION

a. Decisions of the Station management with respect to the Promotion are final.

b. One (1) potential prize winner will be selected on Monday, June 25, 2012 in a random Station-conducted drawing from all eligible online entries received. The Station will notify the potential prize winner by phone on Monday, June 25, 2012. Prize will be awarded upon confirmation of eligibility.

c. Odds of winning depend on the number of eligible online entries received.

d. Winner does not need to listen to the Station or be present to win.

e. The winner must execute and return any required affidavit of eligibility and/or liability/publicity release by 5:00pm PT on July 25, 2012 or prize will be forfeited. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize.

5. CONDITIONS

a. Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other CBS Radio station in Station’s market) in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.

b. By participating in the Promotion, the winner agrees to have the winner’s name, voice and likeness used in any advertising or broadcasting material relating to the Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

c. Prior to awarding any prize or prize certificate, the Station, in its sole discretion, may require Promotion winner (and any travel companion(s) or guest(s)) to sign a liability release, agreeing to release and hold harmless the Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion.

d. If for any reason this Promotion cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate, suspend, or modify the Promotion. If the Promotion is terminated before the original end date, the Station reserves the right to select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date or otherwise modify the procedure for selecting winners.

e. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station’s website. Failure to comply with the rules of the Promotion may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Promotion, the Station reserves the right to disqualify that entrant from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law.

f. The Station reserves the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel, terminate, suspend, or modify the Promotion and shall not be required to award a substitute prize.

g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of a prize.

h. For the names of the prize winners send a self-addressed stamped envelope for receipt by August 24, 2012 to the above address marked “KRTH Online Contest Rules: Yellow Pages- Michael Jackson Immortal Show – Winner List.” The Official Rules and the Winner List (when completed) shall also be available during regular business hours at the main offices of the Station and may be posted online at http://kearth101.com

6. PRIVACY

a. By use of the Station’s website or by entering the Promotion through the Station’s website, you agree to the website’s Terms of Use Agreements located at http://kearth101.com and to the use of your personal information as described in the Privacy Policies located at http://kearth101.com.
