J.W. Marriott Ihilani Resort & Spa 2012 Part 2 Promotion Rules

OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING.

1. HOW TO ENTER

a. These rules govern the J.W. Marriott Ihilani Resort & Spa 2012 promotion (the “Promotion”) being conducted by KRTH FM (the “Station”) beginning on Monday April 16, 2012 at 9:00AM Pacific Time (“PT”) and ending on Friday June 1, 2012 at 5:00PM PT (the “Promotion Period”). Special holiday or countdown programming may affect contesting.

b. To participate in the Promotion, you must listen to KRTH-FM each weekday during the Promotion Period qualifying periods which are 9:00AM PT to 5:59PM PT, Mondays through Thursdays, and 9:00AM PT to 5:00PM PT Fridays, for the announcement of the cue to call. During both qualifying periods, upon hearing the cue to call, the designated number caller (as announced by the on-air personality prior to the cue to call) to get through to the Station contest line at 1-800-232-KRTH will qualify for the current qualifying period’s Grand Prize drawing upon confirmation of eligibility. At the time of their call, callers will be required to provide all information requested including their full name, complete address (including zip code), day and evening phone numbers and date of birth in order to be eligible to win. In the event that the selected caller is disconnected or is found to be ineligible, the next eligible caller that successfully makes it through on the call-in line and completes their call will be a qualifier. There is no limit to the number of times a listener may attempt to call in to qualify, but a listener may be a qualifier only once per week.
c. There are two (2) separate drawings and qualifying periods per week during the Promotion Period. The first qualifying period each week shall take place Mondays, 9:00AM to 5:59:59PM PT; Tuesdays, 9:00AM to 5:59PM PT, and Wednesdays, 9:00AM-5:59PM PT during the Promotion Period. One (1) Grand Prize winner will be selected each Wednesday (starting on Wednesday, April 18 2012 and ending on Wednesday, May 30, 2012) in the 6:00PM PT hour in a random drawing of all qualifiers selected during the first qualifying period for that week. The second weekly qualifying period takes place on Thursdays, 9:00AM to 5:59:59 PM PT, and Fridays, 9:00AM to 5:00PM PT, during the Promotion Period. One (1) Grand Prize winner will be selected each Friday (starting on Friday, April 20, 2012 and ending on Friday, June 1, 2012) in the 6:00PM PT hour in a random drawing of all qualifiers selected during the second qualifying period for that week There will be up to a total of twelve (12) qualifiers selected for each Wednesday drawing and eight (8) qualifiers selected for each Friday drawing on-air during the Promotion Period. There will be a total of seven (7) Grand Prize winners selected each Wednesday during the Promotion Period and a total of seven (7) Grand Prize winner selected each Friday during the Promotion Period. The Station is not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call. Due to delays in the KRTH-FM online streaming of its broadcast signal, listeners to the online stream may not be able to participate in or may be disadvantaged in participating in on-air contests.

2. ELIGIBILITY RESTRICTIONS

a. The Promotion is open to all persons who are 18 years of age or older and who reside in the following Southern California Counties: Los Angeles, Orange, Riverside, San Bernardino, Ventura and San Diego. Employees of the Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, Station’s advertising and promotional agencies, its participating sponsors, other radio stations in the (see above for all eligible countries) metropolitan area, the members of their immediate families (spouse, parent, sibling or child) and those living in the same household of each (whether related or not), are ineligible to enter or win. This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited.

b. Listeners are eligible to win a prize valued at $50 or more or event tickets valued at $100 or more from KRTH-FM only once every thirty (30) days, and listeners are eligible to win a prize in a Promotion conducted by the Station only once every sixty (60) days if the prize is valued over $600 and only once per year if prize is valued over $1,000. Only one winner per household is permitted in any Station promotion.

c. The Grand Prize winner must provide valid government-issued photo identification and provide their complete address, date of birth and phone number to claim a prize.

d. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements.

3. PRIZES

a. Fourteen (14) Grand Prizes will be awarded during the Promotion. Each Grand Prize includes the following: (i) one (1) prize certificates, each valid for a four (4)-night stay for two (2) in a standard room at the J.W. Marriott Ihilani Resort & Spa located at 92-1001 Olani Street Lo Olina, Oahu Hawaii 96707 and (ii) roundtrip coach airfare for two (2) from Los Angeles (LAX) to Honolulu International Airport (HNL). Winner will receive two (2) separate prize certificates, one (1) valid for hotel accommodations, and one (1) with information on how to book air transportation through All Star Travel. Airfare and hotel are subject to availability, blackout dates, and other restrictions. Flight Blackout dates are 06/06/12 – 08/31/12, 11/15/12 – 11/31/12, 12/10/12 – 01/15/13. Blackout dates can change at any time. Class of tickets will be based on the discounted contracted class fares through tickets consolidators of All Star Travel Group. Not valid on published fares unless published fare is lower than the contracted fare. The ARV of each prize is $2,719.00. Certain travel restrictions may apply. Hotel and airfare provider are selected solely at the discretion of the Station. Destinations are subject to change. Destinations cannot be exchanged or traded for another resort awarded at another time. Hotel and Hawaii airport destination dates are subject to change. Travel arrangements must be made through Station-designated agent within sixty (60) days of receiving the certificate. If the winner’s flight and hotel reservation are not booked within sixty (60) days winner will forfeit airfare portion of the prize. Hotel Stay must be arranged through the J.W. Marriott Ihilani Resort & Spa. Prize is subject to availability. If a winner cannot travel on the dates specified by the Station, the winner may be disqualified and an alternate winner may be selected in the Station’s sole discretion. All other costs not specifically stated herein, including but not limited to those of, taxes, meals, tips and ground transportation to/from the airport and/or to/from the hotel, are the responsibility of each winner. Each winner and travel companion must travel on the same itinerary and are responsible for obtaining all required travel documents, including, without limitation, passports for international travel. If applicable, each winner may be required to present a valid credit card upon hotel check in to cover any incidental expenses incurred during the winner’s stay. Each winner and travel companion must sign a Publicity, Liability Waiver and Travel Release form prior to traveling. If a selected event is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, or for any reason beyond the control of the Station, the Station’s sole responsibility to the winner will be to award the remaining available portion of the prize and no substitution or compensation will be provided for the un-awarded portion of the prize.

b. All prizes or prize certificates may be picked up at the office of the Station at the address below. The winners will forfeit any prize or prize certificate not claimed within Thirty (30) days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.

c. There is no substitution, transfer or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes or cash of comparable value. The prizes are expressly limited to the item(s) listed above and unless otherwise expressly specified, do not include taxes, gratuities or any other expenses. Other restrictions may apply.

4. WINNER SELECTION AND NOTIFICATION

a. Decisions of the Station management with respect to the Promotion are final.

b. Fourteen (14) Grand Prize winners will be selected on-air during bi-weekly drawings that will take place on Wednesdays and Fridays during the Promotion Period. Qualifiers for the two drawing periods will be selected as described in Section 1 of these Official rules.

c. Odds of being a qualifier depend upon the number and order of calls received. Odds of a Qualifier winning the Grand Prize on a Wednesday are 1 in 12 and the odds of a Qualifier winning the Grand Prize on a Friday are 1 in 8.

d. Winners will be notified by phone between 5:40PM PT and 6:40PM PT on the drawing days (Wednesdays and Fridays). Winners will be announced on-air at 6:40PM PT.

e. Participants must listen to the Station to become a qualifier for the Grand Prize but do not need to be present to become a qualifier. Grand Prize winners need not listen to the Station or be present to win.

f. The winners must execute and return any required affidavit of eligibility and/or liability/publicity release within thirty (30) days of winning or prize will be forfeited and an alternative winner will be selected by a random drawing from that week’s qualifiers. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize.

5. CONDITIONS

a. Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other CBS Radio station in Station’s market) in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.

b. By participating in the Promotion, the winner agrees to have the winner’s name, voice and likeness used in any advertising or broadcasting material relating to the Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

c. Prior to awarding any prize or prize certificate, the Station, in its sole discretion, may require Promotion winner (and any travel companion(s) or guest(s)) to sign a liability release, agreeing to release and hold harmless the Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion.

d. If for any reason this Promotion cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate, suspend, or modify the Promotion. If the Promotion is terminated before the original end date, the Station reserves the right to select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date or otherwise modify the procedure for selecting winners.

e. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station’s website. Failure to comply with the rules of the Promotion may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Promotion, the Station reserves the right to disqualify that entrant from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law.

f. The Station reserves the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel, terminate, suspend, or modify the Promotion and shall not be required to award a substitute prize.

g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of a prize.

h. For a copy of these Official Rules, send a self-addressed stamped envelope for receipt by Friday June 1, 2012 to “J.W. For the names of the prize winners send a self-addressed stamped envelope for receipt by August 1, 2012 to the above address marked “J.W. Marriott Ihilani Resort & Spa 2012 – Winner List.” The Official Rules and the Winner List (when completed) shall also be available during regular business hours at the main offices of the Station and may be posted online at http://www.Kearth101.com.
